KART ProCare Online Store Terms and Conditions

Definitions

The following terms are used in these Terms and Conditions:

  • Buyer - a natural or legal person, as well as an organizational unit without legal personality that has legal capacity under special legal acts, who places an Order in the Store.
  • Entrepreneur - a natural or legal person, as well as an organizational unit specified in Article 33 §1 of the Civil Code, conducting business or professional activity in their own name.
  • Company / Seller - KART ProCare (Inh. Oleksii Lambrakis), registered address: Bergstraße 1C, 63579 Freigericht, Deutschland. Email: kart.podo@gmail.com.
  • Civil Code - the Act of April 23, 1964 (Journal of Laws No. 16, item 93 as amended).
  • Terms and Conditions - these Electronic Services Terms and Conditions in the Online Store. Acceptance of the Terms by the Buyer is a condition for concluding a sales contract.
  • Интернет-магазин — веб-сайт, доступный по адресу kart-podo.eu, с помощью которого Покупатель может, в частности, оформлять Заказы.
  • Product - goods presented in the Online Store. Information about Products on the Store's pages (description, technical parameters, price, etc.) constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  • Sales Contract - a contract for the sale of Products, as defined in the Civil Code, concluded between the Company and the Buyer using the Store's website.
  • Act on Special Conditions of Consumer Sale - the Act of July 27, 2002 on special conditions of consumer sale and amendments to the Civil Code (Journal of Laws No. 141, item 1176 as amended).
  • Act on Providing Electronic Services - the Act of July 18, 2002 on providing electronic services (Journal of Laws No. 144, item 1204 as amended).
  • Order - a declaration of will by the Buyer aimed at concluding a sales contract, specifying in particular the type and quantity of Products; may be placed through a personal account or without creating one.
  • Personal Data Administrator - a person or organization that decides on the purposes and methods of processing personal data; the Company is such an Administrator.
  • General Data Protection Regulation (GDPR) - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
  • User Account - a place in the data transmission system designated by an individual login and password, where information about the user registered in the Store is stored.

Online Store Usage Rules

The Seller sells specialized products for pedicure, manicure, cosmetology, as well as skin and foot care products online within Germany and the EU. By individual agreement with the Customer, the Seller has the right to ship orders outside the EU.

The Buyer can place Orders through the website, either using a User Account or without one. To create a User Account, it is necessary to provide a nickname, an active email address, and a password. A valid email is required in all cases. The ability to place an Order depends on the chosen delivery location.

Prices for Products and delivery costs indicated on the website are final (including VAT) and expressed in euros (EUR).

The sales contract between the Buyer and the Seller is considered concluded after placing the Order and receiving confirmation of successful order to the Buyer's email.

To fulfill the Order, the Buyer must provide all necessary delivery data: recipient's data, address (street, house/apartment, postal code, city). The cost of delivery and packaging is indicated during the ordering process and added to the Product price.

The Store processes Orders from Monday to Friday, from 10:00 to 16:00. Order processing is carried out within 1-6 working days after receiving payment. Orders are shipped on Tuesdays and Thursdays, unless these days fall on holidays. The delivery time of the order depends on the logistics company you choose and is based on the terms and conditions provided by that company.

Order Process

An order can be placed through a special order form on the Online Store website or through the Buyer's personal account. After creating a User Account, the Buyer gains access to additional functions: order history, checking the status of the current order (updated automatically), saving delivery addresses, and receiving up-to-date information about products.

An order is placed by selecting Products from the Store's assortment. Adding a product to the virtual cart is done by clicking the 'Add to Cart' button.

Products are placed in the cart, which is displayed in the upper right corner of the website. After selecting the 'Proceed to Checkout' option, it is necessary to enter the Buyer's data required for concluding the transaction and shipping the goods. The order process is completed by clicking the 'Place Order and Pay' button. Placing an order means the Buyer's consent to conclude a sales contract on the terms relating to the selected Products.

Confirmation of order acceptance is made electronically by sending an email to the email address provided by the Buyer. The confirmation contains, among other things: order number, delivery address, list of ordered items, total order value, information about the chosen payment method.

The general provisions and rules (these Terms and Conditions) are recorded, stored and available on the Store's website in the section. "Terms and Conditions".

Payment

Payment for the order is made before its processing.

The Buyer is obliged to pay for the order in the Online Store by choosing one of the payment methods offered by the Seller.

In individual cases (for example, with high order value, large quantity of goods, or suspicion of providing incorrect data), order processing may only begin after additional confirmation by phone or your banking application.

Order fulfillment depends on product availability in stock. If a product is unavailable, the Buyer is notified by email. If some products are unavailable, the Seller offers a replacement, extension of deadlines, or order cancellation.

In accordance with the provisions of the Value Added Tax Act (from January 1, 2020), the Seller can issue an invoice to a VAT payer (EU VAT) only if the Buyer provides their VAT number when placing the order. It is not possible to provide it later.

An invoice or corrective invoice is provided to the Buyer in PDF format to the specified email.

Available payment methods in the Online Store:

  • PayPal - when choosing this payment method, the Buyer is redirected to the PayPal system, where after logging into their account linked to a bank card or account, they confirm the transaction by clicking the 'Pay' button. The amount is automatically deducted from the specified account.
  • Stripe - when choosing this payment method, the transaction is processed through the Stripe payment system.
  • Klarna - when choosing this payment method, the transaction is processed through the Klarna payment system.
  • Bank transfer - when choosing this payment method, you are provided with an invoice for payment with the details of the Seller's company.

Order Refusal

The order will not be processed if the Buyer has not paid 100% of its amount before the purchase of the goods.

The Seller reserves the right to limit the sale of certain goods based on current stock levels.

The Seller has the right to limit the quantity of goods participating in promotions or sales.

The Seller has the right to refuse to fulfill an order if its execution is impossible for technical or material reasons. In this case, the Buyer is notified by email or phone, and the paid amount is returned to the same bank account.

Delivery

Delivery of ordered goods is made to the address specified by the Buyer. Orders are accepted and fulfilled within Germany and EU countries. By individual agreement with the Customer, the Seller has the right to ship orders outside the EU.

Delivery is carried out through partner delivery services (for example, DHL, Deutsche Post, Hermes, etc.). Before shipment, the goods are checked for quality and completeness. When receiving the order, the Buyer is obliged to check the integrity of the packaging in the presence of the courier and, if necessary, draw up a damage report with the courier's signature. This report is the basis for considering a claim.

Goods are delivered to the Buyer or a person at the delivery address.

The Buyer (or representative) is obliged to be at the delivery address on the day of order receipt.

The Seller is not responsible for the impossibility of delivery due to the Buyer's fault (for example, incorrect address or absence of recipient).

The Seller is not responsible for payment of duties and other customs fees when shipping orders outside Germany.

Claims

The Seller is responsible for delivering goods without defects.

In case of discrepancy between the delivery and the order, the Buyer must notify the Seller and refuse to accept the unsuitable goods within 14 days after receiving the goods.

If the goods have a defect, the Buyer has the right to demand:

  • replacement of the goods
  • price reduction
  • repair of the goods
  • refund for this goods
To file a claim, the Buyer sends a letter to kart.podo@gmail.com no later than 14 days from the date of receipt of the goods, indicating: full name, order number, photo of the defect and desired solution (replacement, repair, refund, discount).

The complaint is considered within 14 days. Lack of response within this period means a positive decision in favor of the Buyer.

Refund for confirmed defective goods is made within 7 days after positive consideration of the complaint, to the Buyer's bank account or by another method agreed with the Buyer.

The Seller is not responsible for deterioration of the quality of the goods after its transfer to the Buyer, if it occurred for reasons beyond the Seller's control.

Right to Withdraw from Contract

The consumer Buyer has the right to withdraw from the distance sales contract without giving any reason within 14 days from the date of receipt of the goods, by sending a written statement to the Seller's address: KART ProCare (Inh. Oleksii Lambrakis) Bergstraße 1C 63579 Freigericht Deutschland

The 14-day period is counted from the day of actual receipt of the goods.

The right of return is excluded in the following cases:

  • audio, video and software products after opening the packaging;
  • goods produced to individual order;
  • goods that quickly perish or have a limited shelf life;
  • goods in sealed packaging that cannot be returned after opening for hygienic reasons;
  • items subject to rapid wear (for example, tool blades, files, consumables).

In case of contract return, it is considered not concluded, and the parties are obliged to return what they have received. Refund is made within 14 days from the date of receipt of the goods by the Seller.

The goods returned by the Buyer must be properly packaged and protected to avoid damage during transport (cardboard box and filler, such as foam or bubble wrap). If the goods were delivered in original packaging, they must be returned in the same packaging.

The costs of packaging, shipping the goods back to the Seller, as well as the associated risks are borne by the Buyer.

The cost of the returned goods will be sent to the Buyer's bank account no later than 7 days from the date of receipt of the goods by the Seller, provided that the goods are received without damage during transport. Sending goods cash on delivery is not allowed.

Terms of Use of KART ProCare Newsletter

The Buyer may consent to receive the newsletter of the KART ProCare online store. The newsletter is sent only to those customers who have registered for it by checking the appropriate box in the registration or order form, selecting the 'Subscribe' function and agreeing to receive commercial information to the specified email address, in accordance with the legislation on the provision of electronic services.

Within the newsletter, information may be sent by email to the email address specified by the Buyer. The newsletter contains, in particular, information about KART ProCare product offers.

The newsletter service is provided free of charge and for an indefinite period.

Both the Buyer and the Seller may at any time and without giving reasons terminate the contract for the provision of the newsletter service in electronic form.

The Buyer may at any time and without giving reasons change the email address to which the newsletter is sent, or unsubscribe from it by clicking the 'Unsubscribe' link at the bottom of each newsletter, entering their e-mail in the appropriate field and confirming the action with the 'Unsubscribe' button.

Final Provisions

The Buyer using the online store is obliged to provide reliable and correct data. The Seller is not responsible for non-performance of the contract if the provided data is false or incorrect.

The Seller is not responsible for non-delivery of messages to the email address specified by the Buyer if this is caused by blocking or deletion of emails by software on the Buyer's computer, blocking by email server administrators, or other failures.

The Seller reserves the right to make changes to these Terms and Conditions. Changes come into force 14 days from the date of their publication on the online store website. For orders placed before the changes come into force and not yet fulfilled, the Terms and Conditions in effect at the time of placing the order apply.

In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, legislation on the provision of electronic services and other applicable laws of Germany and the European Union apply, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation - GDPR).

All disputes between the Seller and the Buyer shall be considered in competent courts in accordance with applicable procedural law.
